Un contract de închiriere redactat în mod corespunzător trebuie să prevadă și situația în care una dintre cele două părți (proprietar sau chiriaș) dorește încetarea contractului înainte de termen. Într-o astfel de situație, partea interesată adresează celeilalte părți o notificare prin care o informează despre acest lucru, precizând data de la care contractul va înceta.

Trebuie făcută diferența între încetarea înainte de termen a contractului, situație care presupune aplicarea unei prevederi contractuale care permite acest lucru, și rezilierea contractului de închiriere, care presupune culpa (vina) uneia dintre părți. Rezilierea contractului de închiriere, care nu este semnat în formă autentică (la notar), nu poate fi făcută „automat”, printr-o simplă notificare. Rezilierea este decisă de către o instanță de judecată, iar executarea (evacuarea) se face prin intermediul executorului judecătoresc (ferească Dumnezeu!).

Nu trebuie făcută confuzie între rezilierea unui contract și declarația unilaterală (pe proprie răspundere) a proprietarului la fisc, privind încetarea sursei de venit din cedarea folosinței bunurilor. În cazul în care chiriașul nu mai plătește chirie, iar proprietarul nu știe unde să-l găsească (ca în cazul unor cetățeni străini care pleacă din România fără să lase vreo adresă în țara lor de origine), proprietarul emite o astfel de declarație la fisc pentru a opri plata impozitului, dar acest lucru nu are nicio legătură cu rezilierea contractului de închiriere, care rămâne valabil până la termen. O nouă închiriere nu este legală atât timp cât chiriașul nu și-a dat acordul în scris sau o instanță de judecată nu a decis rezilierea contractului vechi.

  2. Modelele de notificare sunt pentru incetarea unui contract de inchiriere, nu pentru rezilierea lui. In situatia rezilierii, de cele mai multe ori este necesara consultarea unui avocat. Trebuie insa facuta distinctie intre relizierea legala a contractului si procedura de sistare a platii impozitului pe un venit care nu mai exista.

  3. Am închiriat o locuinţă pe perioadă nedeterminată. După o anumită perioadă, proprietarul a mers la administraţia financiară şi a reziliat contractul. Eu lucrez într-o instituţie de stat şi primesc bani pentru chirie. La o verificare a instituţiei la administraţia financiară dacă contractul de închiriere este valabil s-a constatat că acesta a fost reziliat. Pe bază de consecinţă, instituţia doreşte să restitui contravaloarea indemnizaţiei de chirie primită de la data rezilierii contractului şi până la data la care s-a făcut verificarea. Doresc să vă întreb dacă este corect şi legal acest lucru.

    • Proprietarul nu poate rezilia unilateral contractul de inchiriere. Administratia financiara, prin inregistrarea pe care o face, da data certa contractului, dar nu poate decide incetarea relatiei contractuale dintre doua persoane. Proprietarul, daca a facut acest lucru, a facut-o pe proprie raspundere. Efectul declaratiei sale este doar stoparea platii impozitului. Ar fi bine sa verificati in ce temei a cerut fiscului sa inceteza sa-i mai calculeze impozit pentru venitul din inchiriere.
      Daca dv. aveti un exemplar original din contractul pe care l-ati semnat cu proprietarul, institutia care va subventioneaza chiria nu ar trebui sa va penalizeze cerandu-va banii inapoi. In absenta unui acord intre proprietar si chirias, rezilierea contractului nu poate fi facuta decat in instanta sau, dupa noul Cod civil, de executorul judecatoresc.

Buna ziua.Tin sa precizez ca ma aflu in aceasi situatie ca dorin.Am incheiat un contract de chirie la circa financiara,si proprietarul a reziliat contractul fara a ma anunta sau a fi si eu prezent cand s-a reziliat la circa financiara.Ca urmare a unei cercetari administrative la servici,comisia a decis imputarea din salariu pe motivul ca „am beneficiat de venituri necuvenite” conform Art.2 si 3 din OG 121/1998 si a pct.3 lit. M si a pct. 6 alin.2 din M 5/1999.Este normal si legal asa ceva atat timp cat eu nu am avut cunostinta despre rezilierea contractului?Va rog sa-mi dati un raspuns at si unsfat ce sa fac in acest caz.Va multumesc anticipat!

Buna ziua.Am in chiriat in anul 2003 un teren de la primarie pept 5 ani pe numele SC ce eram asociat 50%, contractul a expirat, S comerciala desfasurindu-si activitateapina cind noi asociatii am decis sa o radiem respectiv anul 2010,an in care am ers la primarie si am cerut concesionarea terenului pt mine personal. Dintr-un motiv primaria mi-a dat in chirie, cu contract inca 5 ani pe nume personal. Dupa un an si ceva timp in care fostul asociat avea bunuri pe acest teren mai exact in 2012 iulie construeste fara acordul meu un adapost fara aut si fara acordul meu pe motiv ca ar avea si el dreptul la acel teren mai tare a depus si o cerere de reziliere acontractului meu. Drept urmare am instiintat primaria cu adresa scrisa ca sunt abuzat in folosirea terenului si ca sa construit abuziv, si culmea DL primar nu ia nici o masura impotriva exasociatului ba mai mult vrea sa rezilieze contractul meu. Datorita faptului ca nu a luat masuri la istiintarea facuta de mine si mai ales ca ma hartuieste am incetat a mai plati chiria. Recent, 05 06 2013, am primit de la primarie o adresa care vad eu este gresit intocmita astfel in paranteze va voi descrie realitatea fata de ce mi-au trimis ei: „prin prezenta va comunicam ca incepind cu data de 26 03 2013 vi sa reziliat contractul de inchiriere cu nr 11111 din16.09.2012(contr meu este din 2010) pentru nerspetarea clauzelor care prevad la art 7,neplata chiriei pe o perioada de trei luni consecutv autorizeaza pe locator sa ceara rezilierea contractului si plata daune interese astfel am de achitat suma de…(in contractul meu nu este nici un atricol si la clauze plata se va face trimestrial) In continuare „Va rweamintim ca in continutul noului contract calitate de LOCATOR(eu sunt chirias in contract)este detinuta de XY ,numele meu, contractul avind la baza prelungirea vechiului cntract nr 0000 di 16 09 2003 incheiat intre SC>>>>SRL si primaria W. Ce parere aveti , ce vrea sa insemne respectiva fituica,si daca are vreo putere asupra mea. Ce trebuie sa fa dupa primirea ei?     • Desi problema dv. are tangente cu domeniul imobiliar, obiectul contractului in discutie fiind un teren, ea nu este de natura imobiliara, ci legala. Eu nu sunt jurist, iar informatia prezentat de dv. nu este suficienta pentru a putea emite vreo opinie. Sper ca actiunea in instanta ati facut-o cu sprijinul unui avocat.

    Un sfat daca se poate in legatura cu ctr de inchiriere.Am facut un contract cu o institutie pe o perioada de 9 luni iar acum am fost anuntata verbal ca ,persoana care ocupa spatiul a fost demisa si se doreste incetarea contractului.Contractul a fost semnat de catre mine -propietar si de catre pers care reprezenta institutia.Contractul a fost inregistrat la administratia financiara.Care este calea legala de a inceta ctr?Trebuie facuta o notificare din partea chiriasului si atat? sau rezilierea contractului?Cu multe multumiri!

    i rent a house in Bucuresti on my company name. i wanted to take Adeverintafrom the primaria for my company and i saw that the house is not register there for the name of the owner. It was registered to their company that were closed last year. Now i can not take Adeverinta and i want to leave the house. But contract the inchiriere is for 2 years and we have 1 more year to go. i have 2 months deposit with them. if i cancel the contract will i make something againts the law ? or how can i cancel the contract and ask for my deposit back?

    • I don’t understand what kind of Adeverinta you need from Primarie. Perhaps you need the proof the contract was registered to the fiscal authority.
      After la Landlord-company ceased the activity it should notify you regarding the person who continue the contractual relationship.
      I have limited information. You need a lawyer.

  8. O intrebare as avea si eu. Am incheiat un contract de inchiriere a unui apartament, in a carui clauze e prevazut ca..neplata la timp a intretinerii i da dreptul proprietarului sa rezilieze contractul si sa primeasca 2 luni de chirie. Eu am anuntat proprietarul ca ma mut, si ca o sa-i las platite la zi toate cheltuielile( am o restanta la intretinere de 400 lei pe 2 luni). Suparat acesta mi-a spus ca ma v da in judecata si ca solicita desi toate o sa fie la zi platite sa i dau 2 luni de chirie. Intrebarea mea este: poate sa castige 2 chiri printrun proces civil, odata ce eu am platit la zi toate cheltuielile si chiria si nu mi-am recuperat decat jumatate din avans?

    • Daca dv. plati intretinerea, clauza este abuziva. Proprietarul nu va poate cere sa-i platiti echivalentul a doua chirii numai pentru faptul ca ati intarziat plata intretinerii.
      Lasati-l sa va dea in judecata. Am citit ca un cetatean a dat in judecata un preot pentru ca nu a reusit sa scoata dracii din el.
      Important este sa puteti dovedi ca ati platit.

Buna ziua, am incheiat un contract cu o persoana fizica in vederea inchirierii unei garsoniere unde am platit in avans mai multe luni, dar pana la data intrarii mele in imobil acesta s.a umplut de mucegai si nu am mai dorit sa ma mut acolo. I.am comunicat proprietarului in mod verbal ca vreau sa imi restituie banii platiti in ava ns, conform contractului in termen de15 zile, dar termenul a expirat si nu este nici un semn din partea lui cum ca ar avea de gand sa imi inapoieze banii. Pe contract este semnat faptul ca a incasat respectiva suma, am facut fotografii la garsoniera mucegaita toata. Ce am de facut?

  10. Bună ziua. Am un apartament închiriat și doresc sa închei contractul(de comun acord cu chiriașii). În cazul în care deja au semnat un alt contract cu o alta persoana, este necesar sa merg sa declar anularea contractului nostru, sau acesta se anulează de la sine? Iar dacă trebuie sa merg eu sa declar întreruperea contractului, am nevoie de ceva de la foștii chiriași? Va mulțumesc

  11. Buna seara. M am certat cu proprietarul cu care locuiam in imobil si am fugit din locuinta. Doar ii trimit conventia aceea a chiriasului pt a nu mai curge contractul de chirie? Dupa care ce urmeaza? Nu mai doresc sa ne intalnim. Nu vrea sa mi inapoieze bunurile. Am depus plangere

  12. Am aflat ca locatarul meu a ” cedat ” spatiul închiriat unei alte persoane care va urma sa îmi plateasca chiria ; situatia nefiind prevazuta în rezilierea contractului de închiriere , ce act trebuie sa întocmesc catre Administratia Fiscala ? Va multumesc anticipat pentru consiliere .

    Pot merge cu contractul de inchiriere, incheiat in scris intre mine si proprietar, la administratia financiara pentru a-l reclama pentru neplata impozitului

    • Daca sunteti sigur ca proprietarul nu a facut declaratia fiscala ventru venitul din inchiriere, da, puteti sa-l reclamati pentru evaziune fiscala.
      Daca insa se va declansa ancheta in acest caz, trebuie sa stiti ca veti fi implicat intr-un proces penal.

    Am semnat un contract de arendă pe perioadă determinată de 7 ani în 20 august a.c. Înregistrat la primărie, toate formele legale. Specific că eu sunt arendașul și încă nu am înmânat contractele arendatorilor (în număr de 4). Chestiunea este că terenurile sunt INUTILE pentru cultura mea pentru că țin apa, fapt constatat de mine acum cu ocazia unor ploi dese. Întrebare: care este modul în care se face încetarea / rezilierea contractului? Menționez că, deși semnat pe 20.8.14, contractul intra în vigoare începând cu 1.9.14.
    Deasemenea, puteți indica o sursă de unde pot procura documentul reziliator?

    • Un astfel de model de act aditional pentru incetarea inainte de termen a unui contract de inchiriere gasiti AICI.
      El poate fi adaptat pentru situatia arendei.
      De adaugat ca modelele recomandate se refera la situatia in care incetarea inainte de teremen este permisa in mod explicit in contractul de inchiriere. Rezilierea presupune culpa uneia dintra parti, nerespectarea obligatiilor contractuale de cetre aceasta. Daca acesta culpa nu este acceptata/recunoscuta, rezilierea nu poate fi decisa decat de o instanta.

    Am incheiat un contract de inchiriere cu Primaria sectorului 5 al apartamentului meu, unde primaria se obliga sa-mi plateasca chirie pentru o familie (caz social). Problema mea este ca ei nu platesc nici intretinerea nici celelalte utilitati care din gresala noastra sunt pe numele nostru si cresc de la luna la luna. Ce pot eu sa fac sa reziliez acest contract si in primul rand daca se poate intr-un fel.

    • Contractul de inchiriere inregistrat la fisc are titlu executoriu. Va duceti cu el la un executor judecatoresc si cereti evacuarea chiriasului si recuperarea cheltuielilor de intretinere.

    Am un contract de inchiriere pe 12 luni, inceput la 1 octombrie 2014. Chiriasii pe care I-am avut au plecat ieri fara sa ma anunte lasand neplatite utilitatile si intretirerea pentru decembrie-ianuarie. Vreau sa nu mai platesc impozitul la circa financiara si sa imi recuperez datoriile. va rog mult sa imi spuneti cum trebuie sa procedez. Multumesc mult!

    • In situatia in care chiriasul a plecat fara sa va anunte si, mai ales, fara sa semnati un act in aces sens, fiscul accepta o declaratie pe propie raspundere in acest sens.
      In felul acesta, este stopat calculul impozitului de venit, dar nu este reziliat contractul de inchiriere. Daca, de exempu, peste trei luni chiriasul revine, spunand ca a trebuit sa plece inopinat in America, el este in drept sa foloseasca in continuare apartamentul.

        In acest caz, in care chiriasul pleaca neanuntand proprietarul, fara notificare, inainte de expirarea contractului, proprietarul avand posibilitatea de a da o declaratie pe propria raspundere pentru incetarea platii impozitului dar, in contract nu poate sa se specifice clar ca parasirea spatiului inchiriat fara notificare proprietarului eventual chiar in lipsa acestuia si pentru mai mult de 30 de zile (perioada care poate fi considerata echivalentul garantiei), pentru ca acest contract sa poate fi reziliat (actiunea acestuia inceteaza).
        Cum pot sa mai primesc chiriasii care au plecat si revin dupa 3 luni? platile aferente acestor luni cine le acopera daca e la o adica? Inteleg ca nereziliind contractul, acesta are efect in continuare si nu pot inchiria altor clienti (contract nou).
        Cum este legal ca eu sa pot inchiria unor noi clienti dupa plecarea chiriasilor fara sa ma anunte (sa ma notifice) ca lipsesc 1.2 sau 3 luni?
        Sper sa intelegeti ce am vrut sa intreb…

        • In contractul de inchiriere se poate mentiona o astefel de clauza, dar este foarte probabil ca o instanta sa nu o ia inconsiderare. Pot aparea situatii de forta majora care sa justifice nefolosirea spatiului inchiriat o perioada mai mare de timp. Intr-o astfel de situatie, proprietarul nu este in drept sa reintre in folosita sptiului si, eventual, sa-l inchirieze altcuiva. Se poate la fel de bine ca chiriasul sa plece sa sa nu mai reapara niciodata. Sunt situatii si situatii… Vorba unui clasic in viata (din Parlamentul Romaniei): frumusetea dreptului sta in posibilitatea de interpreta Legea.

In primul rand sa va dea Dumnezeu sanatate ca mult bine faceti, apoi va multumesc nespus ptr. toate modelele puse la dispozitie si ptr. toate postarile d-voastra care sunt extrem de utile si informative mai ales ptr. cei in situatia mea, care nu au nici o pregatire in domeniul legii si vor sa incheie un contract de inchiriere ptr. prima data.
    Va rog daca ma puteti ajuta cu niste sfaturi, de pilda eu vreau sa folosesc un model de contract gasit pe net unde la articolul 5 specifica asa:
    „V. REZILIEREA CONTRACTULUI
    5.1. Prezentul contract poate fi reziliat inainte de termenul stabilit in urmatoarele situatii:
    a) pentru neexecutarea culpabila a obligatiilor contractuale de catre o parte; rezilierea va opera de drept, printr-o simpla notificare, fara nici un fel de alte formalitati sau interventie a instantei de judecata (pact comisoriu de grad IV).
    b) la cererea chiriasului, prin notificarea, in scris, a proprietarului, cu cel putin 30 de zile inainte de data pentru care cere rezilierea.
    c) prin acordul scris al partilor, in orice moment al derularii contractului.
    5.2.Chiriasul pierde garantia in favoarea proprietarului, daca rezilierea prezentului contract se produce inainte de termenul stabilit.”
    Imi puteti spune daca este redactat corect, din aceasta postare inteleg ca „rezilierea presupune culpa (vina) uneia dintre parti” deci cele scrise la literele „b” si „c” din modelul meu de contract ar trebuii sa fie incadrate la o alta prevedere contractuala gen: „VI. Incetarea Contractului Inainte De Termen” sau cumva acesta incadrare este necesara doar daca contractul de inchiriere este înregistrat decat la fisc si nu este semnat in forma autentica la notar.
    Si inca ceva, in raspunsurile de aici ati specificat ca: „contractul nu poate fi reziliat decat cu acodul ambelor parti (proprietar si chirias) sau printr-o instanta de judecata” acesta reziliere printr-o instanta de judecata reprezinta cumva acelasi lucru cu denuntarea unui contract, iar daca nu reprezinta acelasi lucru care ar fi diferenta de procedura, de pilda aceasta denuntare de contract trebuie prevazuta la randul ei in contract sau cum?Va rog sa-mi explicati. De pe un forum de avocatura am inteles ca denuntarea inseamna „desfacerea unui contract sau a unui tratat prin manifestarea de vointa unilaterala a uneia dintre parti” atunci nu cumva este posibil ca prin aceasta denuntare de contract sa ne putem proteja impotriva cazurilor gen:
    -chiriasul pleaca inopinat si nu avem acordul lui de reziliere ;
    -chiriasul nu recunoaste nerespectarea obligatiilor contractuale si nu vrea sa-si dea acordul in rezilierea contractului; etc.

  18. Buna ziua,

    Problema mea este următoarea: am închiriat un apartament împreuna cu alte 3 persoane, pe contract suntem doar 2 dintre noi incluzându-ma si pe mine. Contractul este de un an , dar din cauza faptului ca nu ma mai înțeleg cu persoanele din apartament (motive cauzate exclusiv de ei) as vrea sa ma mut. Ei nu sunt de acord însă sa plătească partea mea de chirie, așa cum nici eu nu sunt de acord sa plătesc pentru o locuința in care nu o sa stau. Cum ar trebui sa procedez ? Va rog sa imi răspundeti, sunt studenta , iar cunoștințele mele in acest domeniu sunt destul de vagi.

  19. Buna ziua. Impreuna cu familia tatalui meu am inchiriat- unei persoane juridice -un spatiu comercial, primit ca mostenire.Contractul este pe o perioada de 1 an, din 1 iulie 2014-1 iulie2015. Chiriasul a deschis un magazin in respectivul spatiu. Contractul prevede rezilierea, in cazul neplatii chiriei pe o perioada de o luna. L-a cerintele chiriasului am convenit sa plateasca 25% din chirie in fiecare saptamana, pentru ca suntem 4 proprietari si a spus ca-i este mai usor sa plateasca parte din chirie -saptamanal, decat sa dea toata suma la sfarsitul lunii( cum se prevede in contract).Doar ca din luna noiembrie a inceput sa ramana dator. A platit noiembrie la sfarsitul lui decembrie, decembrie la inceputul lui februarie, iar ianuarie a platit acum, in 9 martie.Noi trebuie sa platim transa a treia din impozitul pe profit in luna martie, desi am primit chiria numai pe ianuarie. I-am solicitat proprietarului plata integrala a lunilor februarie si martie pana la sfarsitul lunii martie, in caz contrar, trecandu-se la rezilierea contractului pe motivul intarzierilor repetate de la plata chiriei. Ce documente trebuie sa incheiem cu acesta pentru reziliere? Ce documente trebuie sa ducem la Fisc, pentru a nu mai plati impozit pe ultimul trimestru, respectiv aprilie-iunie 2015? Multumesc.

Buna am inchiriat cu sotul meu un apartament in urma cu jumatate de an,iar acum suntem amenintati cu rezilierea contractului dupa o cearta cu soacra mea.Aceasta a vorbit cu proprietarii sa ne dea afara pentru a locui ea in imobil.Noi chiria o platim regular,inn fiecare luna am platit la zi atat chiria cat si asociatia.Sunt disperata nu stiu unde sa ma duc sa ii denunt si ce sa fac,va rog ajutatima.Multumesc

  21. Va supun atentiei urmatoarea situatie: sunt asociat la o societate cu raspundere limitata. Administratorul, fara sa stiu absolut nimic, a reziliat contractul de inchieriere al spatiului unde ne desfasuram activitatea. Nu trebuia hotarare AGA, sau notificarea mea in vreun fel? Mentionez ca nu mai am voie sa intru in spatiu, acolo exista mobilier , aparatuta electronica la care nu am acces, nu doreste sa imparta nimic din aceste bunuri cu mine, in conditiile in care am paticipat cu 50 % la achizitia tuturor celor mentionate. De asemenea, la momentul incheierii contractului s-a achitat o garantie , contavaloarea a 2 luni de chirie.
    Va rog sa imi spuneti daca este legal cum a procedat si ce pot face eu incontinuare pentru a recupera ceva .

  22. Am un contract de inchiriere a unei garsoniere care expira in decembrie. Pentru ca doresc sa ma mut, de comun acord cu proprietarul, am decis sa incheiam contractul intr-o luna.     Am inchiriata o garsoniera pe 2 ani, ce serveste ca si sediu social si pct de lucru pt SRL-ul pe care il administrez.
    Din diverse motive, am ajuns la un comun acord cu proprietarul (PF) sa incetam contractul de inchiriere.
    Ce act ar trebui sa ii dau eu properietarului? O conventie de incetare contract inchiriere prin acordul partilor este suficient, semnata si stampilata din partea mea si in 2 exemplare? E ok pentru a putea depune la Finante pentru oprirea platii impozitului pe venitul din chirii?
    Subliniez ca avem stipulat in contract un termen de 30 zile cu anticipatie pe care sa il respectam reciproc daca se doreste incetarea contractului. Acest lucru s-a intamplat deja, urmand incetarea de la 1 august.

    As dori sa va explic si speta mea cu speranta ca ma puteti lamuri ce pot face in acest caz.
    Am incheiat un contract de inhirirere spatiu comercial in care a fost introdus un articol in care mie ca si LOCATAR nu mi se da dreptul de a rezilia contractul in schimb LOCATORUL are acest drept. Necitind bine contractul, am semnat si acum sunt in situatia in care doresc incetarea contractului si mi se spune ca nu pot. Acest contract s-a incheiat pe un termen definit de 12 luni.
    In concluzie, as dori sa stiu daca am vreo cale de atac intrucat consider ca acest articol este unul abuziv. Precizez ca am notificat LOCATORUL de dorinta mea de a inceta contractul pe motiv ca nu sunt incasari astfel incat sa pot sa plati valorea chiriei insa acesta nu doreste incetarea contractului.

    • O astfel de clauza pare abuziva (pentru ca nu exista simetrie), dar nu este. Asa ati semnat si asta inseamna ca ati acceptat.
      Acum, daca aveti dovezi contabile ca business-ul ne merge, ca mai multe luni consecutiv ati inregistrat pierderi, puteti sa notificati aceste lucruri locatorului. Ar trbui sa inteleaga si mai bine va dezleaga acum decat mai tarziu, pentru ca chirie tot nu va mai vedea. Chiria restanta nu loloseste la nimic locatarului, iar avocatii si executorii cer bani multi si… in avans. Daca are intelepciune si daca intr-adevar locatia nu aduce profit, va accepta despartirea.

    • Veste buna este ca Registrul Comertului initiaza din oficiu procedura de radiere a firmei care are sediul expirat. Deci fostii dv. chiriasi fie isi vor schimba sediu, fie (la un moment dat) firma va fi radiata.
      Nu stiu sa va spun dupa cat timp de la expirarea termenului contractului de inchiriere este declansata procedura de radiere. Sigur nu este prea mare.

Am incheiat un contract de inchiriere pentru un spatiu comercial, spatiu care de-a lungul anilor are niste probleme pe care proprietarul nu le-a rezolvat.(curge apa din plafon, instalatia electrica cedeaza din cauza consumatorilor electrici iar instalatia nu suportul un asemenea consum,etc.)am depus scris mai multe adrese prin care s-au angajat ca le vor remedia, lucru care nu s-a intamplat.Din aceste motive eu fiind nevoita sa-mi caut alt spatiu,iar printr-o notificare am cerut rezilierea contractului.Au spus ca vin sa ia in primire spatiul si dupa acea semneaza, au venit la fata locului, au luat spatiu in primire dar n-au semnat rezilierea pentru motiv ca nu-i contabila la serviciu.Eu intre timp m-am mutat, am incheiat un alt contract pentru un alt spatiu.Ce-i de facut in aceasta situatie?

    • Daca un reprezentant legal al proprietarului a semnat un provec verbal de predare-primire corect intocmit, atunci mai aveti o speranta sa vi se semneze si actul aditional de incetare a contractului de inchiriere, desi logica cerea ca oridinea sa fie inversa. Insistati, altfel va puteti astepta cu o noua factura pentru plata chiriei.

    • Contractul de inchiriere intregistrat la fisc are titlu executoriu. Va puteti adresa executorului pentru plata chiriei. Daca platesc, evacuarea nu poate fi decisa decat de instanta, chiar daca a expirat contractul de inchiriere.

    • Contractul de inchiriere este legea partilor. Daca proprietarul a primit chiria (si aveti dovezi pentru acest lucru), se presupune ca el a acceptat in mod tacit prelungirea contractului de inchirere in aceleasi conditii, deci cu obligatia de a va da un preaviz de cel putin 30 de zile. Faptul ca nu respecta contractul va pune in situatia de a consulta un avocat si, eventual, de a apela la jutitie. Aveti de ales: negocierea si intelegerea sau instanta de judecata.

  30. Buna ziua. Va prezint urmatoarea situatie: am un contract de inchiriere semnat cu un chirias si inregistrat la fisc, 2016 care a expirat in luna februarie. Chiriasul a plecat din apartament cu doua zile inainte de expirarea contractului, lasandu-si bunurile personale (haine, obiecte mici) in el (a plecat din tara pentru o perioada nedefinita). Are restante la plata facturilor si la ultima chirie. Ce e de facut, pentru a clarifica situatia cu el si a inchiria altcuiva apartamentul? Cum sa procedez cu bunurile lui? Ce se poate face pentru recuperarea restantelor cumulate?

    • Destul de greu de dat un sfat. Sunt doua situatii extreme posibile:
      1) Chiriasul a plecat, a lasat in apartament lucruri personale minore, fara prea mare valoare, si nu mai are de gand sa revina. Datoriile, sunt „cadoul” dv. Daca ii puteti da de urma, il puteti chema in instanta. Trebuie sa vedeti insa daca merita efortul. In aceasta situatie, reintrati in folosinta apartamentului si va vedeti de viata dv.
      2) Chiriasul este intr-o situati exceptionala (forta majora) si nu v-a putut anunta despre acest lucru. De exemplu, a suferit un accident. In aceasta situatie, daca intrati in apartament ar putea avea ceva de reprosat. Ar putea pretinde ca i-au disparut lucruri etc. Suntem in situatia in care buna credinta nu exista. Cea mai rea posibila.
      Fara un „semn” de la chirias, nu puteti sa deosebiti in care dintre situatiile de mai sus va aflati. E o chestie de fler si curaj. Daca luati prea multe ipoteze in considerare, nu mai faceti nimic, ca nu cumva sa incalcati vreo lege sau sa aiba cineva ceva de reprosat.

    Am inchiriat unei firme un garaj pe durata determinata. De comun acord vrem sa incetam contractul de inchiriere inainte de expirarea contractului. Una din clauzele de incetare a contractului mentioneaza:”II. Prin acordul partilor, in conditiile stabilite de comun acord”. As dori sa stiu daca in acest caz trebuie sa trimit o notificare scrisa inainte de semnarea conventiei de incetare, tinand cont ca, acelasi capitol din clauzele de incetare mai contine un alineat: „III. Inainte de expirarea contractului, la cererea oricareia dintre parti, cu un preaviz scris de 30 de zile. Data rezilierii va fi ultima zi din luna de referinta”.
    Contractul a fost incheiat la notar. Este nevoie de autentificarea conventiei de incetare a contractului?

    • Contractul principal de inchiriere poate contine orice. Daca partile sunt de acord sa inceteze contractul si semneaza in acest scop un act aditional, nimic nu mai conteaza.

    • Prin succesiune ati primit de la parinti si cele bune si obligatiile. Trebuie sa duceti la sfarsit contractul existent si sa notificati din vreme arendasul ca sunteti noii proprietari ai terenului si ca doriti sa nu mai prelugiti contractul de arenda. Inregistrati notificarea la arendas sau trimiteti-o prin posta cu confirmare de primire. Precizati in curprinsul notificarii elementele de identificare ele terenului (localitate, suprafata, tarla, parcela) si numarul contractului de arenda.

    • Daca declaratia de venit a fost facuta cu precizarea termenului corec al incetarii contractului de inchiriere, nu trebuie sa faceti nimic. Ar fi trebuit totusi sa dezbateti succesiunea, pentru ca dupa decesul mamei dv., venitul revine mostenitorilor. Este necesar un act notarial care sa stabileasca cine sunt acestia.

Transmiti-mi va rog , daca cotractul este inregistrat la finante mai este necesar sentinta judecatoareasca , evacuarea in ce conditii de poate reealiza ( este necesar actionarea in judecata prima data si ulterior evacuarea de catre executor…? ) . Contractul de Inchiriere este pe perioada determinata 5 ani , notificarea de incetare a contractului dupa cate zile o pot transmite dupa 30 sau 60…? .     • Inregisrarea contractul la fisc ii da acestuia titlu executoriu. Chiar daca aveti clauza mentionata in contract, prima etapa la care va apela executorul este executarea chiriasului pentru chiria restanta si pentru plata utilitatilor. Va lua din contul bancar al chiriasului, fara acordul lui, sumele restante. Daca sunteti multumit cu acest lucru, va duceti la un executor judecatoresc daca nu, la instanta.

    • Singura cale de a-i obliga este instanta. Sau, mai exista o speranta, sa asteptati sa expire contactul de inchiriere sau de comodat. Dupa o perioada de la expirare (sase luni?), Registrul Comerului radiaza din ociciu firma daca nu isi declara un nou sediu cu acte legale. Deci, trebuie sa-si declara firma in alta parte, altfel ar fi radiata.

    • Actual aditional trebuie sa contina aceleasi parti contractante, data semnarii si modificarile la contractul pricipal (prelungire termen, modificare chirie etc.). Actual aditional are aceeasi forma ca si cel principal.

  41. Buna ziua. Am incheiat un contract de inchiriere a unui apartament pe o perioada de un an, incepand cu data de 03.05.2017. Prima data cand am facut Angajamentul (29.04.2017) am specificat plata lunara in contract de 550 lei plus 550 lei avans. In contractul de inchiriere am specificat plata lunara de 100 lei. Undeva la mijlocul lunii mai proprietarul ma obliga sa semnez un oarecare angajament privind predarea bunurilor din imobil. Nu am fost de acord cu aceasta faza. Am hotarat sa incetez , dar verbal decat contractul de inchiriere, plata de intretinere o am la zi. Proprietarul mi-a spus ca a fost la Finante si a scos contractul. Eu cheile i le-am predat. Acum se eschiveaza sa-mi intoarca avansul si nu am nici o dovada la mana ca am incetat contractul. Cum procedez , trimit notificare proprietaruluisi cum imi recapat avansul?     • Dupa ce faceti o multime de lucruri altfel decat ar fi trebuit, este greas sa va spun eu cu sa le dregeti. De ce ati acceptat sa treceti in contract o chirie mai mica decat cea reala? De ce nu l-atri notificat pe proprietat in scris privind intentia de a inceta inainte de termen contractul de inchiriere (presupunand ca aveati acest drept mentionat in contract)?

    Doresc sa cumpar o casa prin banca (credit ipotecar) si din diverse discutii am aflat ca proprietarul a facut unor neamuri contract de comodat.

  44. Sunt vecin cu o societate care produce pizza. Societatea respectiva isi desfasoara activitatea intr-un sediu inchiriat de la o persoana care este propietar si vecin. Societatea produce fum,mirosuri si zgomot.Toate mirosurile s-au localizat in casa care locuiesc.Mentionez ca sediul unde isi desfasoara activitatea de producere a pizzei este la aproximativ 5m.     Proprietarul unui spațiu a dat anunț pentru închirierea acestuia, în condițiile în care spațiul este deja închiriat, iar chiriașul actual are încheiat cu proprietarul un contract de închiriere pe perioadă nedeterminată.
    Chiriașul este foarte serios, ordonat, a plătit mereu chiria la timp.
    Proprietarul a adus potențiali chiriași în spațiul respectiv pentru vizionare în lipsa actualului chiriaș.
    În anunțul publicat, proprietarul cere o chirie mai mare decât cea din prezent.
    Chiriașul nu a fost anunțat de toate aceste demersuri ale proprietarului.
    Proprietarul a spus eventualilor chiriași că spațiul va fi liber de la data la care se va face următoarea plată a chiriei de către actualul chiriaș, deci atunci se va încheia existentul contract de închiriere.
    Ce poate face actualul chiriaș în situația dată, când nu a primit nici măcar un preaviz, iar proprietarul nu i-a comunicat intenția de a-i rezilia contractul și nici faptul că a pus anunț pentru închirierea spațiului?

  49. Buna ziua, am inchiriat un apartament in august 2022 pt 12 luni. Datorita unor probleme personala si a faptului ca nu sunt in tara, nu am prelungit contractul la expirare. Pe perioada contractuala au survenit schimbari la data platii chiriei astfel incat chiria era platita pe data de 8 pt perioada 21-20 (deci cumva in urma). Luna trecuta am facut o prelungire de contract pe care nu l a semnat datorita unor neintelegeri si am agreat cu chiriasul sa elibereze apartamentul in termen de 60 zile. O zi dupa data scadenta a chirie am primit mail de la chirias ca s a mutat si predarea cheii o va face numai dupa ce ii voi inapoia garantia integral. De la data ultimei chirii, sunt 21 de zile pt care nu a platit. De asemenea, facturile pt lunile anterioare nu sunt platite. M ar interesa care sunt variantele mele avand in vedere ca i am comunicat sumele de plata (chiria pe 20 zile+ facturi) care depasesc valuarea garantiei si nu imi raspunde pt a stabili o zi pentru predarea cheilor. Pot sa intru in casa? Pot sa ma adresez politiei strict pentru reclamarea faptului ca nu imi permite accesul si nu mi a dat cheile?

  52. Buna ziua! Am inchiriat in octombrie 2023 o garsoniera pentru fiica mea in Cluj, pentru o perioada de un an cu posibilitatea de a pleca dupa minim jumatate de an. Garsoniera era in stare buna. În noiembrie cand a venit frigul a apărut mucegaiul. Am vorbit cu proprietara si i-am spus ca vrem sa plecam cu toate ca ea ne-a dat solutii sa folosim dezumidificator și sulutii antimucegai.
