Suprafața utilă versus suprafața construită

Atât la vânzarea, cât și la închirierea unui imobil, apare inevitabil referirea la suprafețe. Se vorbește de cele mai multe ori despre suprafața utilă și despre suprafața construită. Confuzia dintre cele două suprafețe este întreținută în mod intenționat. Cumpărătorul dă prețul metrului pătrat construit, în timp ce cumpărătorul vrea să plătească numai suprafața utilă.

Sa definim aceste notiuni, asa cum apar ele in Legea locuintei, Anexa nr.1:

Suprafața construită este suma suprafețelor utile ale încăperilor, logiilor, balconelor, precum și a cotei-părți din suprafețele părților comune ale clădirilor (spălătorii, uscătorii, casa scării, inclusiv anexele pentru colectarea, depozitarea și evacuarea deșeurilor menajere, casa liftului etc.), la care se adaugă suprafața aferentă pereților interiori și exteriori ai locuinței; în cazul încălzirii cu combustibil solid, se adaugă suprafața aferentă sobelor și cazanelor de baie. Nu sunt cuprinse suprafețele aferente boxelor de la subsol și ale garajelor, care pot fi prevăzute distinct.

Suprafața utilă este suprafața desfășurată din care se scade suprafața aferentă pereților. Suprafața utilă a locuinței este suma tuturor suprafețelor utile ale încăperilor. Ea cuprinde camera de zi, dormitoarele, băile, dușul, bucătăriile, spațiile de depozitare și de circulație din interiorul locuinței. Nu se cuprinde suprafața logiilor și a balconelor, pragurile golurilor de uși, ale trecerilor cu deschideri până la 1,00 m, nisele de radiatoare, precum și suprafețele ocupate de sobe și cazane de baie (câte 0,50 m2 pentru fiecare sobă și cazan de baie), în cazul în care încălzirea se face cu sobe. În cazul locuințelor duplex, rampa, mai puțin palierele, nu se cuprinde în suprafața utilă a locuinței. Uneori apare și noțiunea de suprafață utilă totală (nedefinită în Legea locuinței) ca sumă dintre suprafața utilă și suprafața logiilor și a balconelor.

Suprafața locuibilă este suprafața desfășurată a încăperilor de locuit. Ea cuprinde suprafața dormitoarelor și a camerei de zi.

Suprafața desfasurată a unei case este suma suprafețelor construite pentru toate nivelurile. Dacă imobilul are numai parter, atunci suprafața desfășurată este suprafața amprentei la sol a construcției. În cazul imobilelor cu mai multe niveluri, suprafața desfășurată este chiar suprafața construită. În acest caz, uneori, prin suprafața construită se înțelege suprafața amprentei construcției. Acest termen nu este definit de Legea locuinței.

Prin cotă-parte din parțile de folosință comună ”cota indiviză” se înțelege cota de proprietate care îi revine fiecărui apartament proprietate individuală, din proprietatea comună (casa scării, casa liftului etc.) și este înscrisă în titlul de proprietate. Suprafața construită a unui apartament include și această cota-parte.

Ce se întâmplă în piață: Vânzătorii precizează prețul metrului pătrat construit (fără să menționeze acest lucru), în timp ce cumpărătorii cred că este vorba despre metrul pătrat util. Raportul celor două suprafețe se încadrează în intervalul 1,18…1,20. Când este vorba de preț, 20% contează!

    • Bună ziua..sunt interesat sa cumpăr un apartament..care nu e finalizat încă, suprafața utila find undeva la 49 mp..excluzand balconul care are în jur de 3m.și. .întrebând dezvoltatotul a precizat ca balconul intră în suprafața utilă balconul urmând a fi acoperit și având termopane ….e normal sa plătesc balconul ca suprafață utilă ?

    Am o intrebare:
    Daca cineva si-a daramt peretele dinspre balcon , se mareste suprafata utile a ap. cu suprafata balconului care acum face parte din camera?Cei care au facut acest lucru au o suprafata utila mai mare si deci o contribuitie mai mare la intretinere, caldura?Conform carei reglementari?

    • Daca recompartimentarea apartamentului a fost facuta in baza unui proiect cu autorizatie de construire, pe noile planuri este mentionata noua suprafata utila.
      Acest lucru trebuie notificat la fisc pentru recalcularea impozitului. Evident ca si contributia la plata intretinerii va fi mai mare. Nu stiu sa va spun care este legea. Banuiesc ca este „Legea asociatiilor de proprietari”.

      • Asta ar insemna ca orice spatiu ocupat de mobilier sau aparatura electrocasnica ce ocupa un spatiu intr-un apartament sa fie scazut la impozit . O prostie !
        Si cu pereti si fara ar trebui sa platesc acelasi impozit si intretinere ca si vecinul care are tot acelasi numar de m2 dar poate nu si-a cumparat o lada frigorifica de 2 m2.

  2. Din suprafata utila, face parte o boxa? Boxa se afla la subsolul blocului, nu este incalzita.
    Este trecuta in contractul de vanzare -cumparare si in cadastu, dar, dupa ce a fost facut calculul suprafetelor camerelor de locuit, baie , bucatarie. Unde se reglementeaza acest lucru?

  3. Cum se calculeaza suprafata utila, locuibila in cazul mansardelor?
    Ma refer aici la inaltimea tavanului. exista o inaltime minima sub care nu mai putem lua in considerare spatiu locuibil chiar daca el face parte din incapere?

  4. La un apartament nou, constructorul imi pune pe planul apartamentelor de la un etaj:

    Suprafata utila = 78.81mp
    TERASA = 8.41mp
    Suprafata construita=106.65mp

    E inclusa cumva in suprafata construita 30-40% din casa scarii, fiind cel mai mare apartament pe nivel? Ma afecteaza cumva la impozite, taxe locale, deduceri, etc.?

  5. Care este temeiul legal (…sau formula de calcul) care reglementeaza suprafata desfasurata a unei locuinte ANL.

    Dupa o perioada de 5 ani, UAT poate modifica/prelungi anual, contractul de inchiriere, ocazie cu care va modifica doar scriptic -suprafata locuintei (in contractele vechi suprafata unui apart. cu 2 cam. era de aprox. 60 mp + 9 mp anexe, reprezentand spalator, uscator, boxa;
    – in noile contracte, pentru ACELASI apart. cu 2 cam. regasim o noua suprafata cu aprox. 70% mai mare, suprafa desfasurata de 105 mp, !?…, in cazul cumpararii, ce suprafata vom cumpara ? )

    • In articolul pe care tocmai l-ati citi este precizata sursa care defineste suprafetle unei constructii: Legea Locuintei.
      Daca UAT inseamna Unitate Administrativ Teritoriala, atunci nu inteleg cum aceasta poate modifica un contract de inchiriere si , cu atat mai putin, suprafata unui imobil.

  6. balcoanele unei case p+M construite pe un teren intravilan, se iau in calculul suprafeti utile a casei?Unul este in exterior, iar celalalt este in interior si este practic acoperit de acoperisul casei. Am inteles ca mai noi si aceste balcoane trebuie intabulate si ma gandesc ca constructorul ar vrea sa le introduca in suprafata utila a casei tocmai din acest considerent.Multumesc

    Casa noastra este cu S+P+E+Terasa circulabila.
    In suprafata utila se include si suprafata scarii interioare (de acces intre etaje)? Amprenta la sol cuprinde si balconul de la etaj (suprafata lui fiind de 6,7 mp) care este iesit in consola de la cota de 2,75 m peste sol?

    • In suprafata utila este inclusa si suprafata scarii interioare. Amprenta la sol nu poate include balconul de la etaj, chiar daca este in consola. Acesta se include in suprafata construita.

        In planurile pentru cadastru, conteaza suprafata ocupata de holuri, scara, garaj, balcon, terasa? Aici este o alta poveste? Este luata in calcul suprafata locuibila de fapt? Sau cum stau lucrurile? Daca se impoziteaza intrega suprafata utila, ajungem sa platim sume colosale.

  8. Bună ziua. Am și eu o întrebare. Noi am cumpărat recent un apartament. În extrasul CF acesta are o suprafață utilă de 91 de m2, dar în certificatul energetic apare numai 66,85 m2 utili. Cum putem să ne lămurim această nedumerire și după care dintre cele două documente putem să ne luăm cu adevărat?

    • Cred ca in certificatul de performata energetica este o eroare. Documentul oficial care atesta suprafata corecta a imobilului este planul cadastral. In formatia din acest plan este reprodusa de extrasul de carte funciara.

    Locuiescintru-n bloc nou care are la parter 3 apartamente cu terasa . Apartamentele au trecut in acte suprafata utila de 44m2si terasa de 57m2 iar la plata pe lista de itretinere platesc pe 44m2 este corect? Eu detin o parcare in subsolul imobilului exact sub terasa vecinilor si am fost incarcat cu 30m2 lasuprafata utila estse corect?

    • Raportul dintre suprafata construita si suprafata utila nu poate fi obiectul unei reglementari. El poate fi mai mare sau mai mic in functie de grosimea peretilor, de suprafetele teraselor/balcoanelor etc.
      Fiecare dintre aceste doua suprafete are o definitie clara. Raportul lor matematic se incadreaza (de cele mai multe ori) in intervalul 1,15-,1.25

    • Amprenta la sol a unei constructii nu poate fi definita altfel decat prin aceste cuvinte. Banuiesc ca nu trebuie sa definesc cuvantul amprenta.
      Suprafata construita este definita in cuprinsul articolului.

    Am o problema in sensul ca la cumpararea apartamentului in care locuiesc in contract se face referire doar la suprafata totala ( se enumera tot ce cuprinde inclusiv balcoane ) 55 mp iar in CF la coloana suprafata este trasa o linie iar cei 55 mp sunt consmnati la coloana suprafata utila ( care in realitate si dupa definitia legii locuintei este de 48 mp ( fara balcoane)).
    Problema apare prin faptul ca doresc sa accesez un credit prin programul prima casa si nu o pot face intrucat figurez cu peste 50 mp. suprafata utila in extrasul CF iar in realitate suporafata utila este de 48 mp. ( precizez ca detin si o scita veche anterioara cumpararii unde sunt clar evidentiate aceste 2 suprafete ).
    Se pot face corecturui in CF si daca da cam ce costuri esimative implica

    • Lucrarea cadastrala a apartamentului dv. este probabil realizata in anii 2000. Nu exista rigoarea de astazi. Puteti angaja un cadastrist care sa revizuiasca lucrarea. O sa va coste un pic, dar cred ca merita.

    1) Balconul de la ultimul etaj este considerat drept parte comuna a blocului exact ca si terasa, avand in vedere ca balconul este neinchis si neacoperit asa cum a fost prevazut din constructia blocului ?

    2) Infiltratiile de la apa de ploaie in balconul inferior cauzate de o posibila neetanseitate in planseu cad in sarcina Asociatiei de Proprietari sau exclusiv in sarcina proprietarului apartamentului ?

    • Balconul unui apartament aflat la ultimul etaj este parte din proprietatea acestuia, chiar daca acesta nu este acoperit si/sau inchis. La a doua intrebare nu stiu sa va raspund.

    Am o constructie patrata pe 3 nivele:
    – La parter am o singura camera, inaltimea tavanului fiind pentru jumatate pana la etajul 1 si pentru cealalta jumatate pana la etajul 2
    – Etajul 1 este jumatate din parter
    – Etajul 2 are suprafata utila identica cu parterul.
    Intrebarea mea este:
    Suprafata utila pentru etajul 1 este egala cu suprafata utila de la parter?

    Am si eu o intrebare, va rog. Sunt in punctul de a cumpara un apartament. In cf proprietarului este mentionata suprafata utila, ca fiind 47 metrii patrati. Am primit si schita apartamentului cu toate dimensiunile. Problema a apurut la baie cand in schita era trecut 1,70× 2,80 si in realitate dupa ce am masurat cu mana mea sunt 1,65×2,75. In celelalte incaperi este la fel dupa masurarea lor exacta. Sunt cel putin 5 cm diferenta. La living de ex dupa masuratoarea mea iese cu aproape 1m patrat mai putin (0,88m). Spuneti-mi va rog ce pot face in scest sens, avand in vedere ca apartamentul va fi cumparat prin Prima Casa si am dat deja avansul. Va mulțumesc.

    • Nu puteti sa faceti nimic. Erorile de masurare ca cele mentionate de dv. sunt destul de frecvente. Exiasta si o toleranta admisibila. Nu stiu sa va spun cat este. Incazul dv. ar fi in jur de 2%. Nu consider ca este un motiv sa cereti rezilierea antecontractului. Daca aveti astfet de exigente, trebuia sa masurati inainte de a semna contractul.

  18. intrbare: eu am o casa cu suprafata de 64 m2.pentru impozit iau in considerare si acoperisul?. Daca da, atunci suprafata se dubleaza, banuiesc. Casa fiind tip vagon fete ale acoperisului au forma de trapez, iar celelalte de triunghi. Trebuie sa calculez aceste suprafete separat?. Va multumesc.

  20. Pentru realizarea documentatiei cadastrale pentru prima inscriere, a unui apartament situat la parterul unui bloc ce are carte funciara colectiva, in urma masuratorilor este necesara si obligatorie mentionarea suprafetei construita pe langa cea utila?

    • Da, cadastristul trebuie sa respecte niste regulamente, proprii profesiei lor, in care sunt mentionate elementele care trebuie obligatoriu sa fie mentionate in lucrarea cadastrala.

    Am semnat un antecontract pentru achiziționarea unui apartament intr-un bloc in construcție.
    In antecontract scrie ca suprafața construită este de aproximativ 73,89 mp (inclusiv terasa).
    Recent am primit releveul in care scrie:
    Suprafața utila – 53.66 mp
    Balcon – 4.32 mp
    Suprafața totala – 57.98 mp
    La începutul paginii lângă numărul cadastral mai scrie: Suprafața teren – 10.71 mp.
    Întrebare: Suprafața construită este suprafața totala (57.98) plus suprafața teren (10.71) adică 68.69 mp?
    Menționez ca prețul plătit este pe mp construit iar in antecontract scrie ca ” in măsura in care suprafața construită măsurată va fi mai mică sau mai mare cu mai mult de 3% decât suprafața construită totala prevăzută in antecontract, prețul se va majora sau reduce direct proporțional”

    • Asa cum se mentioneaza si in articol, suprafata contruita este suprafata utila+suprafata peretilor+suprafata balconului. Terenul nu are nicio contributie. In lucrarea cadastrala este metionata acesta suprafata.

    – podul casei – nu este locuibil, poate fi folosit doar pt depozitare, avand sub1.50 m inaltime
    – terasele exterioare casei, deschise, insa acoperite de etajul 1/ balconul de la etajul 1

    De curand am cumparat un apartament cu 2 balcoane inchise in care se afla si calorifere. Pana anul acesta am avut montate repartitoare de caldura si nu am considerat necesar sa utilizam caloriferele din balcoane. Anul acesta asociatia de proprietari a decis sa se renunte la sistemul de centralizare individuala a caldurii si sa platim caldura in functie de suprafata utila.
    In cazul nostru, se vor considera balcoanele suprafata utila? Pot da o declaratie cum ca nu folosesc acele calorifere? Ce trebuie sa fac in acest sens?

  27. Am cumpărat un apartament în construcție, în antecontract e prevăzută: o suprafață utilă de 78,83M2 , la recepție am măsurat apartamentul și suprafață utila sa redus la 76,45 M2. Vă întreb respectos zidurile de despărțire(din interiorul apartamentului) sânt incluse în suprafață utilă? Părțile în comun precum casa scării e inclusă în suprafață utilă a apartamentului , adică împărțită la numărul de apartamente de pe nivele? Vă mulțumesc.

    • Suprafata utila este definita numai pentru constructii, nu si pentru teren. Suprafata utila a garajului este suprafata construita (amprenta pe teren) din care se scade suprafata ocupata de ziduri.

    • Nu-mi este clar daca faceti refrire la terenul de sub terasa sau la constructia numita terasa.
      Daca exista un act (titlu de proprietata) in care se mentioneaza ca terasa este proprietatea vecinului, aceasta suprafata nu poate intra in calcului cote indivize. Este valabil atat pentru terenul de sun terasa, cat si pentru constructie.
