Pentru înscrierea în Cartea Funciară este obligatorie polița PAD

de

Începând cu data de 10 noiembrie 2023, proprietarul unei locuințe va avea obligația de a prezenta contractul de asigurare obligatorie a locuinței, polița PAD, dacă va dori să-și înregistreze sau să modifice înregistrarea proprietății în cartea funciară. Cartea funciară va fi obligată să condiționeze înregistrarea imobilului de prezentarea poliței PAD. 

Obligativitatea prezentării asigurării PAD va exista pentru orice operațiune cerută cărții funciare în legătură cu o locuință (notări, radieri, actualizări de nume sau de adresă poștală etc).

Deși polița PAD era obligatorie și până acum, lipsa penalizărilor a făcut ca puțini cetățeni să o plătească.

De acum, ea va condiționa orice operațiune în cartea funciară și, implicit, vânzările, donațiile, schimburile de locuințe etc.

Pentru înscrierea în Cartea Funciară trebuie prezentată polița PAD

Polița PAD este obligatorie numai pentru locuințe, conform legii nr. 260/20081. Aceasta asigura locuințele împotriva dezastrelor naturale, cum ar fi cutremure, alunecări de teren și inundații. Suma asigurata depinde de tipul construcției: 20.000 euro pentru locuințele de tip A și 10.000 euro pentru locuințele de tip B. Costul poliței PAD este de 20 euro anual pentru locuințele de tip A si 10 euro anual pentru locuințele de tip B. 

Locuințele de tip A și de tip B sunt clasificate în funcție de materialul de construcție al acestora. Locuințele de tip A sunt cele care au structura de rezistență din beton armat, metal sau lemn sau pereții exteriori din piatră, cărămidă arsă, lemn sau orice alte materiale rezultate în urma unui tratament termic și/sau chimic. Locuințele de tip B sunt cele care au pereții exteriori din cărămidă nearsă sau din orice materiale netratate termic.

Excepție fac locuinţele situate în clădirile expertizate tehnic în condiţiile legii de către experţi tehnici atestaţi şi încadrate prin raport de expertiză tehnică în clasa I de risc seismic care, conform Legii 260/2008, Art.3 (6), nu se asigură pentru niciunul dintre riscurile prevăzute de prezenta lege, până la data recepţiei la terminarea lucrărilor de consolidare a clădirilor.

Pentru această categorie de locuințe, la vanzarea lor, notarul va cere dovada expertizării și catalogării în această clasă de risc seismic.
