De regulă, dacă părțile nu convin altfel, costurile sunt suportate de cumpărător, însă acest lucru poate varia în funcție de înțelegerile dintre părți. Important este să discutați deschis despre aceste aspecte înainte de a fixa o întâlnire.

Cine alege și cine plătește notarul?

O regulă elementară impune ca partea care va plăti notarul (vânzătorul sau cumpărătorul) să aibă dreptul să îl și aleagă. Sunt situații în care vânzătorul cere să fie folosite serviciile unui anumit notar, ”pentru că el are toate actele imobilului meu”. Nu este un argument suficient. Cumpărătorul trebuie să fie circumspect. Pot să existe situații în care pentru aceeași situație să fie descrisă în contractul de vânzare în mod diferit de notari și efectele să fie diferite, cu consecințe diferite în viitor.

Ce înseamnă „am notarul meu”?

Unii vânzători sau cumpărători au preferințe pentru un anumit notar, pe baza încrederii sau experienței anterioare. Acest lucru nu exclude o discuție prealabilă pentru a verifica disponibilitatea notarului, dar și compatibilitatea cu cerințele tranzacției.

Ce așteptări să ai de la notar?

Notarul este un garant al legalității tranzacției. Acesta va verifica actele, va confirma validitatea lor și se va asigura că drepturile părților sunt respectate. Rolul său este imparțial, astfel încât toate părțile să aibă încredere în desfășurarea procesului.

Ce diferențe pot fi între notari?
